This website is operated by Office Chair Outlet (“we”, “us”, “our”). By visiting our website and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms, policies and guidelines referenced here or available by hyperlink (e.g., Privacy Policy, Refunds & Returns Policy, Shipping & Delivery Policy, Fair Use & Warranty Policy, Accessibility Policy, GDPR Supplement).

By using the website, you represent that you are at least 18 years old (the age of majority in South Africa), or you are the age of majority in your jurisdiction and have given consent for any minor dependants to use this site under your supervision.

You must not transmit worms, viruses, malware or destructive code. A breach of these Terms may result in immediate termination of access to the Service.

We reserve the right to refuse service to anyone, for any lawful reason, at any time. You understand that your content (excluding payment card data) may be transferred unencrypted and involve transmissions over various networks and changes to conform to technical requirements. Payment card data is always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service, without our express written permission. Headings in these Terms are for convenience only and do not limit or affect the Terms.
3. Accuracy, Completeness & Timeliness of Information
Information on this site is provided for general guidance. We are not responsible if the information is inaccurate, incomplete, or out of date. Any reliance on site material is at your own risk. Historical data may not be current and is provided for reference only. We may modify site contents at any time, but we have no obligation to update any information unless required by law.

Prices (in South African Rand, inclusive of VAT where applicable) and product availability are subject to change without notice. We may modify or discontinue the Service (or any part/content thereof) at any time. We will not be liable to you or any third party for such modification, price change, suspension or discontinuance.
5. Our Products & Services
Certain products or services may be available exclusively online and may have limited quantities. Returns and exchanges are governed by our Refunds & Returns Policy.
We strive to display product colours and images accurately, but we cannot guarantee your device’s display is accurate. We may limit sales of products or Services to any person, geographic region or jurisdiction, and may limit quantities per order. All descriptions and pricing are subject to change at any time at our sole discretion. Any offer is void where prohibited. We do not warrant that the quality of products, services or information will meet your expectations, or that errors will be corrected promptly.
6. Orders, Billing & Account Information
We reserve the right to refuse any order. We may, in our discretion, limit or cancel quantities purchased per person, household or order (including orders placed under the same account, credit card, or using the same billing/shipping address). If we change or cancel an order, we may attempt to notify you via email and/or the billing address/phone number provided when the order was made. We may refuse orders that, in our judgement, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information and to promptly update details (including e-mail and payment card expiry dates) so we can complete transactions and contact you as needed. For more details, see our Refunds & Returns Policy.
7. Optional Tools
We may provide access to third-party tools, which we neither monitor nor control. You acknowledge that such tools are provided “as is” and “as available” without warranties, representations or conditions of any kind. Any use of optional tools is entirely at your own risk and discretion. Future services/features released through the website will also be subject to these Terms.

Certain content, products and services available via the Service may include materials from third parties. Third-party links may direct you to websites not affiliated with us. We are not responsible for examining or evaluating the content or accuracy, and we do not warrant. Suppose you send us submissions (e.g., product reviews, ideas, proposals) whether requested or not. In that case, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide licence to use, reproduce, modify, publish and distribute such content in any media. We are under no obligation to maintain submissions in confidence, compensate you, or respond.
We may monitor, edit or remove content that we determine in our sole discretion is unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that violates any party’s intellectual property or these Terms. You agree your submissions will not violate any third-party rights, contain unlawful or abusive material, or malware, and will not mislead us or others as to their origin. You are solely responsible for your submissions and their accuracy.

Your submission of personal information through the store is governed by our Privacy Policy (and, where applicable, our GDPR Supplement). We process personal information in accordance with applicable South African law, including the Protection of Personal Information Act, 2013 (“POPIA”).
11. Errors, Inaccuracies & Omissions
From time to time there may be information on the site or in the Service that contains typographical errors, inaccuracies or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times or availability). We reserve the right to correct errors, inaccuracies or omissions and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate, at any time without prior notice (including after you have submitted your order), to the extent permitted by law.
12. Prohibited Uses

We may terminate your use of the Service for violating any prohibited use.
13. Disclaimer of Warranties; Limitation of Liability
We do not guarantee that your use of the Service will be uninterrupted, timely, secure or error-free, or that results will be accurate or reliable. Except as expressly stated by us or required by applicable law (including the Consumer Protection Act, 2008 (“CPA”)), the Service and all products delivered through the Service are provided “as is” and “as available”, without warranties or conditions of any kind, express or implied (including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, durability, title and non-infringement).
To the fullest extent permitted by law, Office Chair Outlet and its officers, employees, agents and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, savings, data or goodwill, arising out of or related to your use of the Service or products, even if advised of the possibility. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under the CPA or other applicable law.
14. Indemnification
You agree to indemnify and hold harmless Office Chair Outlet, its affiliates, officers, directors, agents, contractors, service providers and employees from any claim or demand (including reasonable legal fees) made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party rights.
15. Severability
Suppose any provision of these Terms is determined to be unlawful, void or unenforceable. In that case, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed. Such determination shall not affect the validity and enforceability of the remaining provisions.
16. Termination
These Terms are effective unless and until terminated by either party. You may terminate at any time by ceasing to use the site and notifying us. If, in our judgment, you fail or we suspect that you have failed to comply with any provision, we may terminate this agreement without notice and deny you access to the Service. Obligations and liabilities incurred before termination shall survive termination.
17. Entire Agreement
These Terms, together with the policies referenced herein and posted on the site, constitute the entire agreement between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals (oral or written). Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
18. Governing Law & Jurisdiction
These Terms and any separate agreements whereby we provide you Services are governed by the laws of the Republic of South Africa. You submit to the non-exclusive jurisdiction of the courts of Gauteng regarding any dispute arising out of these Terms or the Service. Nothing prevents either party from seeking urgent relief in an appropriate forum.
